WARRANTY POLICY

Unglaz provides a limited commercial warranty designed to protect against verified manufacturing defects and to maintain the quality standards of our jewelry. This Warranty is subject to the terms, exclusions, and limitations outlined below.


This Warranty Policy should be read together with our Terms and Conditions and Returns and Exchanges Policy, available on the Website (www.unglaz.com). In the event of any conflict between this Policy and the Terms and Conditions, the Terms and Conditions shall prevail.


1. Warranty Coverage


1.1 Warranty Period


Unglaz offers a limited three hundred sixty-five (365) day commercial warranty ("Warranty") from the date of delivery to the original purchaser.


For the purposes of this Policy, the date of delivery is defined as follows:


For customers located in the United States: the date of confirmed delivery by the carrier to the shipping address provided.


For customers located in the European Union: the date of physical receipt of the Product by the customer or the customer's designated recipient, in accordance with the EU Consumer Sales Directive (2019/771/EU) and applicable national implementing legislation.


For customers located in the United Kingdom: the date of physical receipt of the Product by the customer or the customer's designated recipient, in accordance with the Consumer Rights Act 2015 Section 29.


For customers located in the United Arab Emirates: the date of physical receipt or delivery confirmation, subject to the protections of UAE Federal Decree-Law No. 15 of 2020 on Consumer Protection.


For customers located in Australia: the date of physical receipt of the Product by the customer, subject to the consumer guarantees under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).


For all other international customers: the date of delivery confirmation by the carrier.


1.2 Scope of Coverage


This Warranty covers manufacturing defects in materials or workmanship that occur under normal and intended use, including:


Structural defects in metal components not caused by external force or misuse.


Loose stones resulting from defective settings.


Malfunctioning clasps, hooks, or closures caused by manufacturing faults.


Coverage applies only where the defect is determined by Unglaz, in a commercially reasonable manner, to be the result of manufacturing or material failure.


1.3 Eligible Products


This Warranty applies exclusively to Products purchased directly from the Unglaz Website at www.unglaz.com. Proof of original purchase is required for all Warranty claims. Acceptable proof of purchase includes the order confirmation email, the Shopify order receipt, or any other documentation that identifies the order number, Product, purchase date, and purchaser.


1.4 Relationship to Standard Returns


This Warranty covers manufacturing defects discovered after the standard return window (30 days from delivery) and up to 365 days from delivery. If a defect is discovered within the 30-day return window (or, for customers in the EU or UK, within the 14-day statutory withdrawal/cancellation period), you may choose to process the item as either a standard return under our Returns and Exchanges Policy or as a Warranty claim under this Policy.


2. Warranty Exclusions


This Warranty does not cover, and expressly excludes:


Normal wear and tear, including scratches, dents, surface marks, fading, or natural aging.


Tarnishing, discoloration, or oxidation resulting from environmental exposure, body chemistry, moisture, or chemicals.


Damage caused by misuse, abuse, accidents, improper handling, or improper storage.


Damage caused by exposure to water, perfumes, lotions, cleaning agents, or other chemicals.


Unauthorized repairs, alterations, resizing, or modifications performed by third parties.


Loss, theft, or damage occurring after delivery.


Products marked as Final Sale or non-returnable at the time of purchase.


Complimentary or promotional items provided without purchase.


Cosmetic variations that do not affect the structural integrity or function of the Product, including minor variations in color, texture, or finish inherent to handcrafted jewelry.


For customers located in Australia, the exclusions listed above do not limit or exclude any consumer guarantees under the Australian Consumer Law. If a Product fails to meet a consumer guarantee, you may be entitled to a remedy regardless of these exclusions.


For customers located in the European Union or the United Kingdom, the exclusions listed above do not limit or override the statutory legal guarantee of conformity or your rights under the Consumer Rights Act 2015. Where a Product lacks conformity, your statutory rights apply regardless of these exclusions.


3. Warranty Claim Process


3.1 Submitting a Claim

Please include proof of purchase (order confirmation email or receipt), a clear description of the issue, and clear photographs or videos demonstrating the alleged defect.


3.2 Acknowledgment and Review Timeline


Unglaz will acknowledge receipt of your Warranty claim within five (5) business days.


All Warranty claims are subject to review and approval by Unglaz. Additional information or documentation may be requested to evaluate eligibility.


Once the Product has been received and inspected (if return is required), Unglaz will communicate a resolution decision within fourteen (14) business days. If additional time is required for complex evaluations, you will be notified of the expected timeline.


3.3 Resolution Options


If a claim is approved, Unglaz will, at its discretion, provide one of the following remedies:


Repair of the Product.


Replacement with the same or a comparable Product, subject to availability.


If the same or comparable Product is not available, Unglaz will offer a full refund to the original payment method or store credit equal to the original purchase price, at the customer's choice.


If repair and replacement are not feasible, a refund will be issued to the original payment method.


For customers located in the European Union, where neither repair nor replacement is possible or proportionate, you are entitled to a price reduction or full refund in accordance with EU Directive 2019/771.


For customers located in the United Kingdom, where repair or replacement is not possible, not completed within a reasonable time, or would cause significant inconvenience, you have the right to a price reduction or a final right to reject the goods and receive a refund, in accordance with the Consumer Rights Act 2015 Sections 23-24.


For customers located in Australia, for a major failure you may choose between a refund, replacement, or compensation for any drop in value. For a minor failure, Unglaz may choose to repair or replace the Product within a reasonable time, in accordance with the consumer guarantees under the Australian Consumer Law.


3.4 Return of Defective Products


Unglaz may require the defective Product to be returned for inspection before any resolution is issued. Return instructions, including the designated return address, will be provided upon claim approval.


Please do not return any Product without prior authorization. Unauthorized returns may be refused or delayed.


4. Shipping Costs for Warranty Claims


4.1 General Rule


For customers located outside the United States, the European Union, the United Kingdom, and Australia, customers are responsible for shipping costs associated with returning Products for Warranty inspection. We recommend using a trackable and insured shipping method, and insuring the return shipment for the full purchase value. Unglaz is not responsible for Products lost, damaged, or delayed during return shipping.


For customers located in the United States, Unglaz will cover return shipping costs for approved Warranty claims.


If a Warranty claim is approved, Unglaz will cover the cost of shipping the repaired or replacement Product to the customer.


4.2 EU Exception


For customers located in the European Union, where a Product is determined to be non-conforming due to a manufacturing defect, Unglaz will bear all costs associated with the remedy, including return shipping costs, in accordance with Article 14(1) of EU Directive 2019/771.


4.3 UK Exception


For customers located in the United Kingdom, where a Product is determined to be non-conforming (not of satisfactory quality, not fit for purpose, or not as described) under the Consumer Rights Act 2015, Unglaz will bear all costs associated with the remedy, including return shipping costs, in accordance with Sections 23-24 of the Consumer Rights Act 2015.


4.4 Australian Exception


For customers located in Australia, where a Product fails to meet a consumer guarantee under the Australian Consumer Law, Unglaz will bear reasonable costs associated with returning the Product for remedy, in accordance with the consumer guarantee provisions of the Australian Consumer Law.


5. Warranty Limitations


5.1 Non-Transferability


This Warranty applies solely to the original purchaser and is non-transferable.


5.2 Warranty Period for Remedied Products


For customers located outside the European Union and the United Kingdom, any repair, replacement, or remedy provided under this Warranty does not extend, restart, or renew the original 365-day Warranty period.


For customers located in the European Union, where a Product is replaced as a remedy under this Warranty, the replacement Product is subject to a new conformity period in accordance with Article 7(1) of EU Directive 2019/771. Where a Product is repaired, the remaining conformity period continues from the original delivery date.


For customers located in the United Kingdom, where a Product is repaired or replaced as a remedy under this Warranty or under the Consumer Rights Act 2015, the repaired or replacement Product benefits from an additional six (6) month period during which the burden of proof regarding conformity rests with Unglaz, in accordance with the Consumer Rights Act 2015.


5.3 Limitation of Liability


To the maximum extent permitted by applicable law, Unglaz's total aggregate liability under this Warranty shall not exceed the greater of (a) the total amount paid by the customer for purchases from Unglaz during the twelve (12) months preceding the claim, or (b) one hundred United States Dollars ($100 USD), as set forth in Section 11.11 of our Terms and Conditions.


Unglaz shall not be liable for incidental, indirect, consequential, or special damages arising from or related to any Warranty claim, to the maximum extent permitted by applicable law.


For customers located in the European Union or the United Kingdom, nothing in this Section limits any mandatory liability for non-conforming goods under EU Directive 2019/771 or the Consumer Rights Act 2015.


For customers located in Australia, nothing in this Section limits or excludes liability that cannot be limited or excluded under the Australian Consumer Law.


Nothing in this Section limits any mandatory consumer rights under applicable law.


6. Care and Maintenance Requirements


To maintain eligibility for Warranty coverage, customers must follow reasonable care practices, including:


Removing jewelry before showering, swimming, or physical activity.


Avoiding exposure to water, chemicals, perfumes, or lotions.


Storing jewelry in a clean, dry environment, preferably in the original packaging or a soft-lined jewelry box.


Cleaning with a soft, lint-free cloth only.


Failure to follow care recommendations may affect Warranty eligibility. However, the burden of demonstrating that a defect was caused by failure to follow care instructions, rather than a manufacturing defect, rests with Unglaz.


For customers located in the European Union, the United Kingdom, or Australia, the care recommendations above do not limit your statutory rights. Where a Product lacks conformity or fails to meet a consumer guarantee, your statutory rights apply regardless of care practices, and the burden of proof regarding the cause of the defect remains as provided by applicable law.


7. Statutory Consumer Rights


7.1 European Union


For customers located in the European Union, this Warranty is a voluntary commercial warranty provided by Unglaz in addition to, and not in replacement of, the statutory rights available under applicable EU consumer protection law, including the legal guarantee of conformity under EU Directive 2019/771 (Sale of Goods Directive).


Under EU Directive 2019/771, consumers have the right to a minimum two (2) year legal guarantee of conformity from the date of delivery. During the first year after delivery, any lack of conformity that becomes apparent is presumed to have existed at the time of delivery unless proven otherwise. These statutory rights cannot be waived, limited, or excluded by contract.


This Warranty does not limit, reduce, or replace these statutory rights in any way.


7.2 United Kingdom


For customers located in the United Kingdom, this Warranty is a voluntary commercial warranty provided by Unglaz in addition to, and not in replacement of, the statutory rights available under the Consumer Rights Act 2015 and related legislation.


Under the Consumer Rights Act 2015, you have the following rights regarding goods:


Short-term right to reject: Within 30 days of delivery, you have the right to reject goods that are not of satisfactory quality, not fit for purpose, or not as described, and receive a full refund.


Right to repair or replacement: After the initial 30-day period and up to six (6) years from delivery (five (5) years in Scotland), you may request a repair or replacement of non-conforming goods.


Reversed burden of proof: During the first six (6) months after delivery, any lack of conformity that becomes apparent is presumed to have existed at the time of delivery unless proven otherwise.


Final right to reject: If repair or replacement is not possible, not completed within a reasonable time, or would cause significant inconvenience, you have the right to a price reduction or the final right to reject the goods and receive a refund.


These statutory rights cannot be waived, limited, or excluded by contract. This Warranty does not limit, reduce, or replace these statutory rights in any way.


7.3 United Arab Emirates


For customers located in the United Arab Emirates, this Warranty is a voluntary commercial warranty provided in addition to, and not in replacement of, the mandatory consumer protections available under UAE Federal Decree-Law No. 15 of 2020 on Consumer Protection and the warranty obligations under the UAE Civil Code.


Under UAE consumer protection law, you have the right to receive goods that conform to their description and are free from defects, and you may be entitled to remedies including repair, replacement, or refund where goods are found to be defective.


This Warranty does not limit, reduce, or replace these statutory rights in any way.


7.4 Australia


For customers located in Australia, this Warranty is a voluntary commercial warranty provided by Unglaz in addition to, and not in replacement of, the consumer guarantees available under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).


Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.


The consumer guarantees under the Australian Consumer Law are not limited by any time period specified in this Warranty. This Warranty does not limit, reduce, or replace these statutory rights in any way.


7.5 Canada


For customers located in Canada, this Warranty is a voluntary commercial warranty provided in addition to, and not in replacement of, the mandatory consumer protections available under applicable federal and provincial consumer protection legislation, including but not limited to the Consumer Protection Act (Quebec), the Sale of Goods Act (Ontario), and equivalent provincial statutes.


These laws may provide implied warranties of merchantability, fitness for purpose, and compliance with description. This Warranty does not limit, reduce, or replace these statutory rights in any way.


7.6 Other Jurisdictions


For customers in other jurisdictions, this Warranty does not limit or exclude any mandatory consumer rights provided under applicable local law. Where such laws provide additional protections, those protections apply in addition to this Warranty.


8. Force Majeure


If Unglaz is unable to fulfill a Warranty remedy (repair, replacement, or refund) due to events beyond its reasonable control, including supply chain disruptions, natural disasters, or other Force Majeure events as defined in Section 12 of our Terms and Conditions, Unglaz will notify the customer and fulfill the remedy as soon as reasonably practicable after the Force Majeure event has ended.


For customers located in the European Union or the United Kingdom, Force Majeure does not suspend or override your statutory rights regarding non-conforming goods.


9. Interpretation


Unglaz reserves the right to interpret the terms of this Warranty and to determine eligibility, coverage, and appropriate remedies in a commercially reasonable manner. Any ambiguity in this Warranty shall not be construed against either party.


10. Policy Updates


Unglaz may update this Warranty Policy from time to time to reflect changes in practices, products, or legal requirements. Any updates will be published on the Website with a revised "Last Updated" date.


Updates to this Warranty Policy do not affect claims arising from purchases made before the update, which remain subject to the version of the Warranty Policy in effect at the time of purchase.
